The US Supreme Court has helped clear the way for the next round of special trials by military commissions at the terror detention camp at Guantánamo Bay, Cuba.

On Monday, the court declined to take up a joint appeal filed by former Osama bin Laden driver Salim Ahmed Hamdan of Yemen and Omar Khadr, a Canadian national, who faces murder charges for allegedly throwing a hand grenade that killed a US soldier in Afghanistan. Mr. Khadr was 15 years old at the time.

This matter is Hamdan II, the case following the legislative fix of Hamdan I.

The substantive law issues here are more interesting than the procedural. What the United States is saying is that these guys are bandits, criminals not entitled to the privileges of lawful belligerency. This is so even if they have not comitted a separate war crime, such as killing prisoners, as the way they fight is the crime.

This is extremely important. We are saying that the sand-critter way of war--no uniforms, hiding in mosques, all that sort of thing--is per se criminal. It is altogether necessary that we should take this position, and it is consistent with the policies behind the Law of War.
