Why Libby's Defense Failed (REYNOLDS HOLDING, 3/06/07, TIME)

Though outing a CIA agent can be illegal, no one was charged with doing that to Plame. Instead, Fitzgerald went after Libby for lying. Though seemingly a side issue, Fitzgerald told reporters it was like "throwing sand in the umpire's face," a serious transgression that stops investigators from doing their jobs. Today, Fitzgerald came back to that theme, stressing that to "have a high-level official do that under oath in a national security investigation is something that's not acceptable."

The consequences for lying under oath should be harsh. But it should be consistent too. Sandy Berger walked and Bill Clinton did no jail time so I don't see why Libby should.

Russert was the bulk of the winning case. I'm convinced he both lied and willfully misled under oath. I continue to have reasoned doubt that Libby did.

Fitzgerald said yesterday that the highest pursuit of justice was the truth.

Odd statement from a prosecutor who let so many skate on by (Russert, David Gregory, Mandy Grunwald, Armitage, Powell, Ari Fleischer, Bob Woodward, Jill Abrahamson, etc.), while squeezing only a few (Libby, Judy Miller, and perhaps Karl Rove).

And why was David Corn never called?

Perhaps the case will be overturned because Andrea Mitchell was never put on the stand (which would have contradicted Russert, her boss).

Libby's lawyers fumbled the case when they made it seem that he was a 'fall guy' for the big fish in the White House. The jury felt sorry for Libby, but convicted him anyway. The defense should have played offense, and tried to get Joe and Valerie involved. More grounds for appeal, no? They couldn't directly attack Fitzgerald (too bad).

Not truth generically, or he'd have to prosecute all of us. Just truthful answers to questions that federal prosecutors ask you. It seems the least we can require of public servants.
