Military Wins at U.S. High Court on Campus Recruiting (Bloomberg, 3/06/06)
The Bush administration can demand that universities give military recruiters the same campus access as other employers, the U.S. Supreme Court ruled, rejecting free- speech arguments by law schools opposed to the armed services' ban on acknowledged homosexuals.The justices unanimously upheld a government policy of threatening to cut off federal funds, in some cases hundreds of millions of dollars, from universities that don't provide equal access. The ruling reversed a lower court decision said the policy violated university speech and associational rights.

Something that my former state of residence (South Dakota) has learned the hard way over the years. Also, something that Louisiana is learning the very hard way right now.

Nowhere is this more obvious than in the realm of education, wherein the public school system attempts to exercise a stranglehold on civil society with money taken from civil society.
So now the mechanisms the Left had relied on for all these years are coming back to bite them in the a**. Chickens coming home to roost never made me sad; they only made me glad.

Of course, Justice Ginsburg slept through about 15-20 minutes of the hearing last week.

The USSC did not address the issue of whether Congress can require this of universities if they receive federal funds. The USSC said that Congress could require this as a first principle, regardless of whether federal funds were involved, therefore the funding issue was moot. That is an incredibly strong decision.

An effective leader has the ability to influence others in such a way as to win their understanding, cooperation, participation, and ultimately their allegiance. Justice Roberts will lead the court to many unanimous or near unanimous decisions.

It was listed on several 'righty' blogs (can't remember which offhand), and I even saw a FOX News screenshot with a sketch of her head on her desk, with Alito on one side and Souter on the other. According to what I read, neither man nudged her.
