WE DIDN'T MEAN OUR OPPONENTS SHOULD CRIMINALIZE POLITICS ALSO!

There goes the Judge: Recusals prompted by Rep. Tom DeLay's legal team get the case off on the wrong foot (Houston Chronicle, 11/05/05)

When sidelined House Majority Leader Tom DeLay's attorney filed a recusal motion against veteran Travis County state District Judge Bob Perkins, he cracked the lid of a judicial Pandora's box that could haunt the state for years.

Now that a judge's out of court political activities are fair game, such motions will likely become a routine weapon for every lawyer who has a client involved in politics.

The Houston Chronicle editorial board, long critical of Rep. DeLay, didn't seem so unhappy over Ronnie Earle's criminalization of politics.

The Chronicle's editorial board must have a case of long term memory loss and/or all their story files and microfilms/CD-ROMs of past editions must have been lost in the great downtown Houston flood of 2001. Bob Perkins recused himself in the 1994 trial of Kay Bailey Hutchison prosecuted by Ronnie Earle, and DeLay's attorney, Dick DeGuerin, got Hutchison's trial moved from Austin to Fort Worth before Earle dropped the case entirely. If it's a crisis now, it should have been a crisis then.

However, since the Chronicle's editorial board does seem to remember that "...Judge Priest, a highly regarded senior jurist who has been appointed to cases since he was defeated by a Republican opponent in 1994," we have to assume only selective items were washed away in the flood, or that the Chronicle's editorial writers only have selected memory loss (Of course the truth is they weren't paying as much attention in '94, since the Democrats controlled both houses in Austin and Washington, as well as the governorship and the presidency. So Perkins recusal 11 years ago wasn't a major crisis because they thought the overall political landscape was frozen in amber, and Tom DeLay was just a crank Republican from the city's southwestern suburbs).
