Canada Court Clears Way for Gay Marriage (Associated Press, December 9, 2004)
Canada's Supreme Court ruled Thursday that gay marriage was constitutional, a landmark opinion allowing the federal government to call on Parliament to legalize same-sex unions nationwide.If approved by a majority of the House of Commons, as widely expected, Canada would become the third country to embrace marriage by homosexuals and lesbians. Belgium and the Netherlands are the other two.
However, the court added that religious officials cannot be forced to perform unions against their beliefs. It also declined to answer a contentious question about whether traditional marriage between men and women also was constitutional.
Gay marriage is still an abomination but it's certainly preferable for courts to hold it constitutional and then leave the matter to legislatures than to hold it a right and require specific action by the legislature. Posted by Orrin Judd at December 15, 2004 11:58 AM
Agree. But the Canadian court knew the legislature would approve, American courts have no such assurance, hence the overreach.
Posted by: LUCIFEROUS at December 15, 2004 12:43 PMI still say the answer to this is to just say, "Fine, we'll allow gay marriage. We'll also start calling marriage between a man and a woman REAL MARRIAGE. Got that?"
The gays will be infuriated, because this isn't about marriage at all to gays, it's about forced validation of the gay lifestyle by the public at large.
