Expert Cited by CBS Says He Didn't Authenticate Papers (Michael Dobbs and Howard Kurtz, September 14, 2004, Washington Post)

The lead expert retained by CBS News to examine disputed memos from President Bush's former squadron commander in the National Guard said yesterday that he examined only the late officer's signature and made no attempt to authenticate the documents themselves.

"There's no way that I, as a document expert, can authenticate them," Marcel Matley said in a telephone interview from San Francisco. The main reason, he said, is that they are "copies" that are "far removed" from the originals.

Matley's comments came amid growing evidence challenging the authenticity of the documents aired Wednesday on CBS's "60 Minutes." The program was part of an investigation asserting that Bush benefited from political favoritism in getting out of commitments to the Texas Air National Guard. On last night's "CBS Evening News," anchor Dan Rather said again that the network "believes the documents are authentic."


Of course, Mr. Rather still believes peppered moths prove Darwin right.

CBS has been awfully quiet. I think this guy who posted on Instapundit may be onto something:

CBS is full of smart people. It makes no sense to say they're stalling because they believe these things are genuine. They know what we all know. They are stalling to get their ducks in a row:

They are speaking to lawyers to see if a crime has been committed.

They are speaking to lawyers to see if they can/must/may disclose the source.

They are speaking to lawyers to see if they must make disclosure in their SEC filings.

They are speaking internally to see who will resign.

They are speaking internally to see how they will word their retraction.

All that takes time. That is why CBS hasn't updated anything on this for too long. That is why their intitial counter-attacks (e.g., the first version of Times New Roman was invented in 1931), which are obviously inadequate, aren't being buttressed by anything new.

As a news organization and as a publicly traded company, they can't issue half-truths once they suspect what really happened. They are getting ready to make all their announcements at once.

Within 48 hours, CBS will come clean with a noise rivaling the disappearance of Krakatoa."

I'd like to agree with Jeff but I still get the sense CBS is going to try and ride this one out by stonewalling and letting newer events take over the attention of the public (more violence in Iraq, the Kitty Kelley book, football/baseball, etc). Rather looks foolish as no one credible says the documents are real but is it enough to get him gone?

Speaking as someone who has examined documents experts in court, Matley has it exactly reversed. You can't draw definitive conclusions about handwriting when the known exemplar and questioned document are photocopies. You can conclude (based on typeface, etc.) that photocopies are forged.

If CBS were a stand-alone corporation I'd tend to agree, but they aren't. I have a hard time believing that Sumner Redstone is going to sacrifice his reputation and Viacom's share price to save Dan's sorry a**.

It was passing curious why CBS would go to a San Francisco handwriting 'expert' when New York and Washington are full of them (many highly trained, retired FBI and Postal Inspector experts). Know I know.

Very interesting to see that Laura Bush gave the first 'official' comment on the documents. Dan is looking like Wile E. Coyote, after running 30 feet off the cliff, and just realizing that there is no ground left. The puff of smoke at the bottom will be exquisite.

BTW, has anyone asked old Walter his opinion of the situation?

If this were a court case, no one would get a chance to cross-examine Matley. All he can testify to is that the signature on one memo appears to be a degenerate copy of LTC Killian's signature. He can't say that Killian actually signed that memo and he can't say anything about the other three documents. Frankly, in a lawsuit I don't think that a competent lawyer would even offer his testimony.

It turns out you have misrepresented the history of the study and report of Biston betularia.

I'll go into it, if you like, but you'd be better off finding another example to pound.
