MOTHER OF ALL FIGHTS (via Volokh Conspiracy):
Supreme Court (Scripps-Howard News Service, 3/14/2003)Supreme Court vacancies? Sen. Edward Kennedy, D-Mass., says he's been told there will soon be two, and is rearranging his staff for what is expected to be the mother of all fights on Capitol Hill to stop any Bush nomination.
Note the slip by the reporter -- letting it out that the Democrats want to "stop any Bush nomination."
Well, if fight there must be -- bring it on, baby.
Posted by Paul Jaminet at March 15, 2003 3:18 PMI think it was Fred Barnes who made the point that the President needs to get more involved in a public way, traveling, doing speeches, making the news, the bully pulpit, etc, as well as using his powers as arm-twister in chief, being Johnsonesque, calling Senators into the oval office and leaning on them until they unravel. He's got get more aggressive. The RNC should be running pro-Estrada commercials on Telemundo 24/7.

I agree but I think Bush is a little busy right now. Bush will not make the mistake his father made in ignoring the economy during the war but it may be that the judicial nominees get filibustered/obstructed for the next 2 years with the GOP hoping the Dem actions will increase the GOP majority in '04 and help clear the backlog.
Bush has to get the story out so people know that the Democratic behavior is novel and destructive of comity. His only real retaliatory weapon is to shut down Great Society, and other liberal, programs until there's an agreement. But he won't do this 1 year before the 2004 election. Maybe in 2005.
