PRISONER "RIGHTS"? (via John Resnick):

Inmate who sued to get abortion is transferred (ROSANNA RUIZ, 2/06/03, Houston Chronicle)
Harris County jail officials on Thursday transferred to state prison a pregnant inmate who had filed a federal class-action lawsuit the day before against the county for repeatedly denying her request for an abortion.

The inmate's transfer to state custody had been pending for days, said Jim Faulkner, staff attorney for the Harris County Sheriff's Department. He said he was "not aware of any connection" between the timing of the woman's transfer and the filing of the lawsuit.

Annette Lamoreaux, an American Civil Liberties Union attorney who filed the suit on the inmate's behalf, said she intends to proceed with the lawsuit against County Sheriff Tommy Thomas despite the woman's transfer. Thomas is named as the defendant in the suit because he oversees county jail facilities.

You lose any number of enumerated rights when you're sent to prison, surely you don't keep one that merely emanates from a penumbra. Posted by Orrin Judd at February 7, 2003 4:58 PM

It's how Justice Harry Blackmun discovered privacy rights sufficient to cover abortion in Roe v. Wade
