European Union Plans WTO Complaint (JOHN W. MILLER, 2/03/09, WSJ)

The European Union is likely to file a complaint at the World Trade Organization if the $800 billion-plus U.S. stimulus plan contains a "Buy American" provision, EU officials say.

The problem, these officials say, is that a clause forcing Washington to favor U.S. goods, as some lawmakers would like, might violate the Government Procurement Agreement, a WTO-treaty that prohibits discrimination in government spending.

"We would have to look at our all options, including a WTO case, if 'Buy American' passes," an EU official says.
