NO HURRY:
Court To Review Recall Delay (AP)
Without commenting on the merits, the 9th U.S. Circuit Court of Appeals said it would convene an 11-member panel to consider the timing of the vote on whether to recall Gov. Gray Davis. For the moment, Friday's action delays a likely appeal to the Supreme Court.Posted by Orrin Judd at September 19, 2003 03:19 PMA date for the rehearing was not immediately announced.
Is anyone else concerned that they may delay their decision--upholding the delay--until the 6th or so, making it too late for an appeal to the Supremes?
It would be decidedly evil--but this is the 9th, after all, and they certainly seem to think that someone did the same to him, so I don't see it as outside the realm of possibility.

Howard Bashman says on his 'How Appealing' blog that the word is that oral arguments will be next Monday afternoon.
As for a decision .......... the only time pressure on the Court is whatever pressure they feel.
