NO HURRY:

Court To Review Recall Delay (AP)

Without commenting on the merits, the 9th U.S. Circuit Court of Appeals said it would convene an 11-member panel to consider the timing of the vote on whether to recall Gov. Gray Davis. For the moment, Friday's action delays a likely appeal to the Supreme Court.

A date for the rehearing was not immediately announced.

Is anyone else concerned that they may delay their decision--upholding the delay--until the 6th or so, making it too late for an appeal to the Supremes?

It would be decidedly evil--but this is the 9th, after all, and they certainly seem to think that someone did the same to him, so I don't see it as outside the realm of possibility.

Why not delay the decision until the 8th, after the election? Then they can see the results before deciding whether to obviate them.

Howard Bashman says on his 'How Appealing' blog that the word is that oral arguments will be next Monday afternoon.

As for a decision .......... the only time pressure on the Court is whatever pressure they feel.
